Studies: Some nursing home elderly get futile care

LOS ANGELES — A surprising number of frail, elderly Americans in nursing homes are suffering from futile care at the end of their lives, two new federally funded studies reveal.

One found that putting nursing home residents with failing kidneys on dialysis didn't improve their quality of life and may even push them into further decline. The other showed many with advanced dementia will die within six months and perhaps should have hospice care instead of aggressive treatment.

Medical experts say the new research emphasizes the need for doctors, caregivers and families to consider making the feeble elderly who are near death comfortable rather than treating them as if a cure were possible – more like the palliative care given to terminally ill cancer patients.

"We probably need to be offering a palliative care option to many more patients to make the last days of their lives as comfortable as possible," said Dr. Mark Zeidel of the Beth Israel Deaconess Medical Center in Boston, who was not involved in the studies.

Palliative care focuses on managing symptoms of a disease and a main goal is to relieve pain at the end of life.

LOS ANGELES — An anguished bodyguard, saying he had to tell what he knew about Anna Nicole Smith's death "or I'm going to die," testified Wednesday that he saw her boyfriend-lawyer Howard K. Stern inject her with a sedative at a time before her death when she was begging for something to help her sleep.

Maurice Brighthaupt said he had seen Stern inject Smith with medications four or five times in Florida and the Bahamas, and also watched the celebrity model's psychiatrist, Dr. Khristine Eroshevich, inject her once but did not specify the drug. He said he also saw Smith inject herself twice.

Brighthaupt's testimony came during a preliminary hearing to determine if Stern, Eroshevich and Dr. Sandeep Kapoor will stand trial for conspiring to illegally provide Smith with controlled substances,

All three have pleaded not guilty. The defendants are not charged with Smith's death at a Florida hotel in 2007, which was ruled an accidental overdose.

Outside court, Stern's lawyer Steve Sadow said he would prove in cross-examination Thursday that the guard had reason to testify falsely.

LOS ANGELES — A judge says there's enough evidence against a man accused of stalking Shawn Johnson for the case to go to trial.

Los Angeles Superior Court Judge Michael Carter made the ruling after concluding a preliminary hearing for Robert O'Ryan, who has been jailed since his arrest in March. Authorities say he trespassed on the lot where "Dancing With the Stars" is taped and tried to contact Johnson.

The 17-year-old Olympic gold-medal gymnast won the dancing competition earlier this year.

Johnson and her parents have obtained a civil restraining order against the 34-year-old Florida man. Authorities said they found a pair of loaded guns in O'Ryan's car and that he drove from Florida to Los Angeles to try to meet Johnson.

Michael Jackson earns American Music Awards nod

NEW YORK — Michael Jackson has a chance to win artist of the year posthumously at the American Music Awards.

The pop superstar, who died on June 25, was among a diverse group of artists nominated Tuesday for the top honor. Country star Taylor Swift, rapper Eminem, breakthrough rockers Kings of Leon and flamboyant pop star Lady Gaga were the other nominees.

Swift topped all artists with six nominations. She drew inadvertent attention at the MTV Video Music Awards last month when rapper Kanye West interrupted her acceptance speech to say Beyonce deserved the award instead.

Jackson followed Swift with five nominations and Eminem received four.

Winners are determined by an online vote of fans and will be announced at a Los Angeles ceremony televised by ABC on Nov. 22. The nominees were selected through a measurement combining sales and radio airplay.

NASHVILLE, Tenn. — Taylor Swift says she is "absolutely walking on a cloud" over her six nominations for the American Music Awards.

"I've never been nominated six times for any award show," the country star said Tuesday before a benefit concert in Nashville. "This is just such a wonderful day for me."

Her tally, announced on Oct. 13, even beat late superstar Michael Jackson, with five nods and rapper Eminem, with four.

"It's the 13th today, and 13 is my lucky number, and that's when I found out about the AMAs. It's like, I swear, good things happen on the 13th for me, and I can't believe all those nominations."

The 19-year-old is up for the AMA's big award, artist of the year, alongside Jackson, Lady Gaga, Eminem, and rock band Kings of Leon.
