Saying No to Permanent Global War

The House is expected to vote soon on a bill that hands over to the president Congress' constitutional authority to declare and authorize war, substantially altering the delicate balance of powers that the Founding Fathers envisioned.

The annual reauthorization of the Department of Defense contains unprecedented and dangerous language that gives the president virtually unchecked power to take the country to war and keep us there. This bill significantly undermines the Constitution, the institution of Congress and sets the United States on a path of permanent war.

The Fiscal Year 2012 National Defense Authorization Act (NDAA) declares that the United States is in an armed conflict with not only al Qaeda and the Taliban, but "associated forces" and individuals, organizations and nations that support such forces. The president could then have the full legal authority to send American troops to engage in acts of war anywhere--Yemen, Somalia, Iran, even the United States--without constitutionally required Congressional authorization and, consequently, without any restrictions or oversight from the American people or Congress.

This bill would also make permanent the degradation of law and human rights which has become Guantanamo. It imposes bans on the transfer of any detainee held at Guantanamo, including those who have been cleared of any charges. This means that the United States would be forced to keep imprisoning men who are known to be innocent or are not a threat. This bill not only allows the imprisonment of innocent people, but could mandate it.

The bill also prevents the use of Article III federal courts for the trial of most terrorism suspects. This circumvents our system of justice and our protections under the Constitution, showing a lack of faith in US law enforcement and courts which are the constitutional venues for stopping terrorism. Our federal courts have a long history of trying terrorist suspects, while military courts are untested, lacking in legitimacy and of questionable effectiveness. Since 9/11, federal courts have prosecuted over 400 terrorism-related cases, while military courts have convicted only six.

It's as if the wars in Iraq and Afghanistan never happened. These wars cost thousands of lives of our men and women in uniform, and perhaps a million civilian lives, with long-term costs approaching $5 trillion. Yet, in light of the attempt to try to make permanent an authorization for war, it is as if the consequences of the wars we are in have not occurred. It's as if our "humanitarian" military intervention in Libya, which has helped create full blown civil war and which has ensnared us in yet another military stalemate in the region, never happened. It is as if centuries of evidence of the ramifications of the military overreach of empires never happened. It's as if the Constitution, which requires Congress to have a say in when and where we go to war and which guarantees U.S. citizens the right to a fair and speedy trial, was never written.

Congress must protect the American people from the over-reach of any Chief Executive who is enamored with unilateralism, pre-emption, first strike and the power to prosecute war without Constitutional or statutory proscriptions.

Permanent, global war is not the answer. It will not increase our national security. Far from ridding the world of terrorism, it will become a terrorist recruitment program.

h.r. 1540 can be seen as one of the worst bills ever to be sent to congress for a vote.

$118 billion for the iraq and afghan wars.

$533 billion for the pentagon budget.

the new start treaty implementation is blocked unless there is full funding for a nuclear weapons complex; bars the retirement of nuclear weapons until TWO nuclear facilities are completed; and bars all nuclear weapons reductions below new start levels until approved by congress.

heavily funds the star wars missile defense system to be built in california and alaska

revives AGAIN the second engine for the hyper expensive f-35 that the pentagon has no use for.

bars the transfer of all prisoners from guantanamo forever.

gives presidents the power to launch wars anywhere at any time for any reason.

gives presidents the power to imprison anyone, anywhere in the world (including u.s. citizens within the u.s.) without trial indefinitely.

during a 4 or 8 year presidency we might as well have an absolute king or emperor.

as it is most elected congressmen answer to lobbyists and corporations. they certainly don't vote in the interests of the citizens they should represent.

call your congress reps and senators and demand a "no" vote on the passage of h.r. 1540

Wow. I am sorry to say I knew nothing about this new break with our Constitution. As disturbing as all the others. Feels like there is nothing that can be done about it, our country has changed forever.

My congerssman is no liar, and today that is a real rarity.Congressman Kucinich was the youngest mayor of any major U.S. city at a time when real executive power meant something These so called "teaparty patriots," who constantly tout the U.S. Constitution as their playbook are turning it into a worthless piece of Americana. It would seem at a time when we are constantly bombarded with news that the deficit is rising out of control , we can hardly afford to be involved in undeclared wars either with or without congressional approval. I wish the whole country could know what it is like to have a man of Dennis's integrity representing them in congress.

the only way out of our state of perpetual war is to replace every politician from the president down through both houses of congress who support it with legitimate anti-war candidates.

Rep. Kucinich is right to point to the obvious; them founding fathers would be shocked at our foreign adventures but he neglects to tell us why. American politicians, as embodied by the state of the art-Pres. Obama, "yes Bibi"- are devout cowards overseas. Why? Because Americans are incredibly ignorant about Hawaii, let alone the world beyond New Jersey.

All political arguements are dumbed down for us. "Keep your government hands off my Medicare." Americans have long heard Israel described a "bastion of freedom and democracy", it's part of that 'affinity' thing, but how many have heard an Israeli PM, Barak, describe his government's Palestinian policy as "apartheid". I know, outrageous.

Congress is concerned about reelection, power, and little else, forever. Nobody votes over there so naked self interest is geometrically increased. Congress is an absentee parent. Thousands of lives, trillions of dollars, wasted. Congress: "USA USA USA". As long as American voters don't care until it hurts, Vietnam, our president is an emperor.

Congressman, i totally agree.
What is even more sad are these changes of our new National Security State in the context of the re-authorized Patriot Act.
I think Osama lost the battle but won the war- we are not who we thought we were, are we?

Investigative journalism is almost a dead art. How many of these so-called suicide bombings are actually suicide bombings and not just Blackwater or some other private army drumming up business? There are just not that many people willing to commit suicide for any cause. Our own troops claimed to have seen Taliban member being flown around in our own helicopters. Unlike the movie Wag the Dog these are real wars where real people are killed and maimed only the reasons given are phony. If this bill passes we have lost this country.

Ollie North and Bill Casey supposedly wanted to create an offshore version of the CIA that was funded from within and would have all the congressional oversight committees snooping around. I think with the likes of Blackwater we're finally there.

Permanent war is about the munitions industry making money and about a built-in expansion of the military,. It's not about any need for war. It's been going on since Vietnam, and on a pretty permanent basis. Who wants it? Not us! Winston Churchill called it the "high cabal", Eisenhower called it the "military industrial complex, Truman warned about it. It's rich and very powerful interests who make money on war who keep us in a permanent state of war. Giving the President these powers will put him right in their very deep pockets.

Thank you congressman Kucinich for bringing this to our attention...I and many who are aware of your tireless efforts are most grateful to have a voice for reason and sanity ... sadly few will be hearing the message ..and even fewer will act.. the 'might is right' gang will continue to ridicule anyone who doesn't want thier blind insanity...entrophy seem's to be the course firmly in play as the inequality grows wider with each passing year ...historically the cost of militarism has brought down every Empire to date..both morally and financially ...our's is no exception..

Kucinich is absolutely right. We are becoming a culture where war is the primary, not the last, resort for situations involving any sort of perceived as well as actual threat...and it is occurring through abandonment of our traditional principles and values which is granting our totalitarian and theocratic enemies at least a partial victory. I am glad of the restraint in the Libyan conflict shown by the Administration, but I feel it should likewise follow the legal processes of informing Congress under the War Powers Act. Perhaps the legislative branch might prefer a more direct involvement rather than a lesser one, you cannot tell until they are asked for their cumulative wisdom. But they must be involved under the law. Selective adherence to the law is tyranny, whether by Democrat, Republican or any other political striping. It is our right to have our legislature involved in whether or not we fight. It is the duty of the President to accede to its will, and it is the honor of the nation that is at stake. The Presidential oath is not to "protect the people" at all costs-- it is to preserve, protect and defend the Constitution of the United States against all enemies foreign and domestic. Even when those enemies are unwitting well-meaning people seeking to grease the wheels of military performance.

The planet that sustains the life of all people is having challenges providing for us because of our abuse. We are in this together, we all share one atmosphere and water supply. If we change that we won't be able to afford a military. We have to smarten up or the children of the world pay for what we do today. The money spent on war would feed the world, educate them and use planetary resources responsibly. Our bodies need iron, not in the shape of a tank.
