University Professors Association Is Investigating Ivor van Heerden's Dismissal

In a strongly worded letter, the American Association of University Professors (AAUP) has alerted Michael Martin, Chancellor of Louisiana State University (LSU) that, in its opinion, the firing of Professor Ivor van Heerden "raises significant issues of academic freedom, tenure and due process."

Two months ago, van Heerden, the former deputy director of the Louisiana State University (LSU) Hurricane Center filed a wrongful termination lawsuit in state court against the flagship university.

Van Heerden alleged that LSU officials waged a campaign of retaliatory harassment for his criticism of the federal Army Corps of Engineers. Louisiana State University receives large federal grants from the Corps.

Apparently Chancellor Martin had ignored previously written letters to his office setting forth AAUP's concerns regarding actions taken by LSU administration to terminate the services of Dr. van Heerden.

The most recent letter dated April 5, 2010 puts LSU on alert that the AAUP shall "establish an ad hoc committee composed of persons who have had no previous involvement with the particular matter, to conduct its own full inquiry without prejudgement of any kind." (Hat tip to the Editilla at the New Orleans Ladder for posting this information first.)

When the professor announced his intention to sue LSU, he was flanked by big name supporters including John Barry (author Rising Tide), Harry Shearer (actor, filmmaker), Oliver Houck (Tulane University law professor), Mtangulizi Sanyika (African American Leadership Project), and Jed Horne (author Breach of Faith).

At the time, few media reports mentioned this significant show of support. This ad hoc investigation now shows, yet again, that Ivor van Heerden is far from alone on this journey to find out the truth about Ivor van Heerden's firing.

This should certainly show to the world the total rottenness and corruption of the "establishment" around here.But after all, it is certainly understandable that state and local politicians whould want to protect the Corps. It is a matter of simple GRATITUDE. Look how splendidly the Corps'"engineering" worked out for the politicians and their buddies.They are becomming obese feasting on the GRAFT from the billions of dollars in"disaster relief";which, after all, went into THEIR pockets, not ours.so it is only natural that they should want to protect their "benefactors".

As someone who lives in New Orleans and was here for the hurricane, I know that Prof. Van Herden was a person with the expertise to understand how poorly the levees had been designed. Clearly, his dismissal was due to his honesty regarding what had happened to our city. The hurricane destroyed the gulf coast, but it was the poorly designed levees built by the Corps that flooded 80% of our city. The pilings should have been driven down 60 ft. The Corps only drove them down 16 ft!

Power begats corruption, absolute power corrupts absolutely. LSU has proven beyond a doubt their level of corruption with its termination of staff. The entire process stinks to the high heavens of cash is king mentality. In due course Dr, Ivor van Heerden will be vindicated and proven correct.

I think it is important to note here that this Lawsuit is not about how much the Corps of Engineers got Wrong but about what Dr. Ivor van Heerden Got Right.
That is the problem here.
Dr. Van Heerden got it right Before The Storm. He modeled it down to a friggin golf tee.
Then after the Corps Engineering Failed... Ivor van Heerden got it right AGAIN.
That is the Problem here, to wit: Louisiana drew Ivor van Heerden here. He'd be the first to tell you that. Not a big time career as a problem for LSU's academic credulity.
The man loves Louisiana and the Gulf Coast. I've met him so don't argue with me on that.
And he does his job Very Well. Sooo let's Fire Him???? My ASCE!
Tis'soon Hurricane Season in Louisiana AGAIN, and I need to know what Ivor van Heerden thinks about it!
That's what I'm sayin'. His last day is around May 15th.
This is beyond ridiculous.
I say we go and put a Pie in the Face of the LSU Chancellor on That Day.
What have we got to loose?

I still haven't seen it covered in any "news media", so once again we bloggers have to shovel the stall so to speak!
It is no small wonder that Ivor van Heerden throws his lot in with levees.org and supports your efforts wholeheartedly. I shudder to think how this Greatest Civil Engineering Disaster in History would have spun had Y'all not been on the ball with it like this. I mean, think about it. It is hard enough already getting the Straight Story Told about the Corps' Flood of New Orleans! The Corps and their Contractors have Minions of PR Hacks lined up on Ivor van Heerden right now.
His Cause is a Fulcrum Event.
Thank goodness somebody stepped up with a Louisville Slugger. Really.

New Orleans has been victimized by the Corps of Engineers. Mr. van Heerden has become a victim of LSU's abandoning him apparently because of pressure from the COE. Why are we surprised when elected officials sell their vote instead of supporting the will of their electors when they are taught that integrity is not important by the administration of their state university.

By mid 2006, the civil engineering profession in SE Louisiana was swimming with "Corps work” to repair and improve the damaged levees. It was understood that if your engineering or consulting firm wanted to stay in the Corps' good graces, you would respect those at the New Orleans Corps District and help to drive the critics out of town or out of business.

Corps employees at the New Orleans District began treating their critics as if they were terrorists and enemy of the state. Any detractor was vilified, discredited or worse.

What happened to Ivor van Heerden at LSU, for speaking critically about a federal agency, the Army Corps is happening to others as well, and it's still going on now. Thank you Dr. van Heerden for yet again, doing what was right, and at an enormous personal expense.

Thank you Levees.org for staying on top of this issue long after the media has moved on. It is a university's function to support and encourage the free flow of opinions and ideas. Dr. van Heerden had nothing to personally gain by speaking out against the Army Corps of Engineers for its role in the flooding of New Orleans post-Katrina. He shared what he knew so that another disaster could be averted. Instead of celebrating him LSU fires him. I would like to see LSU's tenured profs stand behind him, or, are they afraid of the hatchet, too? LSU does not, for whatever reason, seem concerned about public opinion on this one. The protests need to come from within. What are LSU's students and profs doing today to keep the heat on LSU over this? I have seen news of protests in the past, but what about now?

I'm with Laura McBride...what happened to respect for thoughtful dissent?

I am very surprised to see LSU (LOUISIANA State University) take this kind of action against a professor who raises legitimate issues (that have been mentioned and raised countless times already.) It shouldn't have to be mentioned that Baton Rouge is an hour west of New Orleans and has seen what so many people in the region went through after the failures that occurred in the wake of Hurricane Katrina. To assess the levees and failures from an sound engineering principles perspective is the logical thing to do to avoid putting people at risk. This is really mind boggling. Get a grip LSU officials!

Excellent news!
This nation has enough problems without our universities teaching students (the future leaders of this country), that honor and integrity should be punished rather than rewarded.
The vindication of Dr. van Heerden, will go much farther than just setting things right in his career. It will stand as a priceless example to LSU students, who will eventually be faced (as we all are at some point) with choosing between the honorable path or the corrupt path.
These students need to see Dr. van Heerden standing tall at the end of this investigation, and those responsible for his deplorable treatment shamed and appropriately reprimanded.

We at Levees.org agree. And we find it interesting that the Chancellor of LSU didn't even respond to letters previously written by this national organization devoted to defending academic freedom and tenure, advocating collegial governance, and developing policies ensuring due process.

It is ridiculous that the administrators at LSU thought that they could get away with such a blatant violation of Professor van Heerden's rights and the principles of academic freedom. LSU has only further discredited itself. What am embarrassment!

My thoughts exactly. This is just nothing but an embarrassment for Louisiana and especially LSU. It's a sad day when the LSU administration would rather support USACE's failed policies than actually help citizens of Louisiana who live in the flood shadow of the USACE's demonstrably feeble levy and flood control system.
