A Big Mistake In Obama's War on Medical Marijuana

For over a year now, the Obama Administration has been steadily escalating its assault on medical marijuana. What was already a mess has been getting worse from one week to the next, and each new attack revives the question of whether the feds have finally taken things too far.

If we aren't there yet, we may well be getting pretty damn close. As the Huffington Post reported last week:

SAN FRANCISCO -- An Oakland medical marijuana dispensary that has been billed as the largest pot shop on the planet has been targeted for closure by federal prosecutors in Northern California, suggesting that a crackdown on the state's medical marijuana industry remains well under way.


U.S. Attorney Melinda Haag has threatened to seize the Oakland property where Harborside Health Center has operated since 2006, as well as its sister shop in San Jose, executive director and co-founder Steve DeAngelo said Wednesday. His employees found court papers announcing asset forfeiture proceedings against Harborside's landlords taped to the doors at the two locations on Tuesday.

What makes this event stand out is Harborside's unparalleled reputation for safety, security and compliance with local laws. The decision to target them contradicts an April interview in which President Obama told Rolling Stone that enforcement efforts focused only on dispensaries that illegally sold marijuana for non-medical use.

Attorney General Eric Holder reiterated that position last month, saying, "We limit our enforcement efforts to those individuals, organizations that are acting out of conformity with state law." He added that dispensaries may also be targeted if they are too close to a school, and indeed, numerous dispensaries have been shut down for operating within 1,000 feet of a school, even in the absence of any actual problems or complaints.

Yet Harborside is not located within 1,000 feet of a school, nor has the organization ever been accused of violating state or local laws. To the contrary, the group is nationally-recognized as the leading example of a well-run, well-regulated medical marijuana provider. National news outlets routinely feature stock footage from inside the facility, where cameras have always been welcome. The group has operated like an open book from the beginning, believing that a transparent and responsible approach would lend legitimacy to the industry.

How then would the feds justify targeting a place that everyone loves? Ironically, by claiming it's too popular:

I now find the need to consider actions regarding marijuana superstores such as Harborside. The larger the operation, the greater the likelihood that there will be abuse of the state's medical marijuana laws, and marijuana in the hands of individuals who do not have a demonstrated medical need. - U.S. Attorney Melinda Haag

This explanation not only contradicts the excuses offered by the president and attorney general, it's also about as incoherent as anything ever uttered in the long and hideous history of federal officials saying stupid things about medical marijuana. This is literally the exact opposite of the truth, in that one well-managed dispensary that consistently upholds the law eliminates the need for numerous others that might not.

This place, by its very existence, has done more to promote legal compliance in the medical marijuana industry than an army of federal law enforcement officials ever could. It has set a standard of excellence that's reverberated though the industry and reduced the exact sorts of abuses that the feds so cynically claim to be concerned about. Harborside isn't the problem, it's the solution.

That's why the Obama Administration's attack on Harborside is so terribly short-sighted. It exposes the reality that they're more afraid of the best dispensaries than the worst. It leaves Obama with no answer the next time this issue comes up, and he ought to know by now that it will. It pits the president against public opinion, even among republicans, and becomes a particular problem in the key swing state of Colorado. Heck, he's even got a fundraiser scheduled next week in Oakland, and you can bet he'd raise more money if he weren't at war with the very industry that's helped revitalize their local economy.

I have no idea whether Obama himself is as enthusiastic about destroying medical marijuana as the folks at DOJ who've been doing the actual dirty work, but the answer to that question doesn't matter. If Obama can blame Mitt Romney for what Bain Capital did while he was CEO, we can sure as hell blame Obama for what the Justice Department does when he's the president.

He told us we could expect better than this. And yet the problem isn't just that he failed to keep his word, or even that his attorney general rather blatantly lied to Congress about it, as awful as that is. The greatest disgrace in all of this is the perpetuation of a reprehensible policy that crushes the will of voters and the wisdom of legislatures, that stands between sick people and the medicine their doctors recommend, that hands control of cannabis back to cartels that kill people, and that creates a continuing war in our own communities when there could so easily be peace.

Obama once said that undermining medical marijuana laws was a poor use of resources, and he was right. But it's not only a poor use of resources, it's also just plain wrong. As a candidate, and as a leader, it's time for our president to make things right.

Punch these into Google Scholar: "Cannabinoids and angiogenesis" "cannabinoids and neuroblastoma" "cannabinoids as antiinflammatories" "cannabinoids as neuroprotective antioxidants" "cannabinoids and mylenation" FOR STARTERS! Cannabis is one of the most useful and least toxic medicines on the planet. It is no more addictive than coffee and dozens of times less toxic than tobacco. Period. Case closed.

I had to think for a while before responding to this article. Why would there be such an emphasis on fighting the ones that are trying to help people. Why focus on the the medical marijuana industry in states where it has been made legal?

Money - loss of money. I can't help but think that this as nothing more than big pharma trying to discourage anyone from pursuing alternative treatments that interfere with their profits. Big pharma doesn't lose money on the people who use marijuana as a recreation drug, but they will lose if people go outside of conventional medicine (conventional meaning the last 40 years), especially a medicine that needs only dirt, water and sunshine.

It's too bad Obama has no one reading Huff post comments. I've been posting for months. Obama once again I send you this message into the ether. The election depends on what you do on marijuana before the election. The people who will stay home were voting for you. Obama you are handing mitt Romney the win by just having a smaller base come November. They don't even have to vote for Romney, he's got plenty of old white Prohibitionists to win this. For f-sakes do some math on this one. Young people are progressive and want/demand change on this issue. Stop smiling and saying platitudes. This next 2 months is your last chance to energize the youth vote. By the way Obama team check my posting history and you can find evidence of this advice forever.

Anyone has the right to change their mind on any issue.Obama,if we can assume has changed his mind on cannabis,has done a 180.So be it.What is unconscionable is his conflicting statements on the issue which are almost always followed with legal actions that are in direct opposition to what he has just stated.Not only is this confusing and misleading.It seems to be planned misdirection ,which leads people who are actually concerned with"doing the right thing"into believing they have nothing to fear.If the idea is to keep honest,hard working people out of the cannabiz,it may be working.This President has admitted that he smoked pot and snorted cocaine for recreational purposes.Now he is attacking people who use cannabis for medical reasons.His actions have stolen the future from a large number of his fellow citizens for doing the same thing that he did himself.He does not have the excuse of ignorance that his VP can claim.He is a hypocrite of the first magnitude.A perfect example of the old saw that power corrupts and absolute power corrupts absolutely.

I personally don't like pot... I hate all smoking. I don't want it near me but I support legalization as long as all the no-smoking laws and DUI laws are enforced. I also support state's rights and Obama has no right to usurp them. I don't like Obama and I don't like Romney but I can't stand watching the liberals support Obama blindly while I watch the Feds raiding a legal dispensary up north, injuring innocent people who are actually working in this economy - while we have so many better things to worry about like jobs and wars.

If you're going to "throw your vote away" at least make it count and vote for Ron Paul. He has far more support than Gary Johnson and is a better choice to boot.

I love Ron Paul. I campaigned for him here in WA state. I contributed $2500 to his campaign too. However, he is not on the November 6th ballot in 50 states like Gary Johnson is.

I expect Ron Paul will get a lot of write in votes, but right now Gary Johnson is polling at 5.3% against Romney and Obama. I'd vote for Ron Paul if he got the GOP nomination, or ditched the GOP and officially went 3rd party against Obama and Romney, but he didn't. So it's Gary Johnson.

We owe a lot to Ron Paul. He's the one who helped to bring people like Gary Johnson out into the open this year.

Spot on .. when is everyone else going to realize that neither party represents the middle class and the poor .. and you are not throwing away your vote ... THEY ARE .. it makes no difference whatsoever who is in the WH or who is in control of Congress .. nothing changes that would benefit the American people .. because neither party represents what America wants .. that's the problem with a two party system .. and until we form a strong third party , nothing will change .

I smoked it when I was very sick and going threw with draws. I hated the taste but it was the only thing that helped me. I only smoked when I needed it and now that I am well I dont smoke. Smoking it helped me so much more than any pill did. I am greatful!!

Remember the Citizen's Handbook? Obama promised that the top-voted item would get action during the first 100 days of his administration -- and item #1 was cannabis reform. Obama shrugged it off with a snicker, on camera, first day on the job.

I remember ... but imo neither party represents what the majority of Americans want and neither party represents the middle class or the poor ... and as long as we keep this two party system , nothing will change that benefits the middle class or the poor .. We are just the people that they lie to , to get elected .. and that's all we are to both parties .
