Obamacare is textbook German Zwangswirtschaft socialism where the government declines to nationalize an industry, but instead abuses its police, taxing and spending powers to direct the industry as if it was the owner to redistribute wealth. This system distorted the economy and failed spectacularly when the Germans used it during WWI and WWII.
If you use employer provided group health insurance, your premiums and/or deductibles went up to pay for the new Obamacare mandates and your plan is being taxed to subsidize the exchanges. Your employer may or may not have disclosed this to you or paid for the increases. If your employer paid for the increases, you will get a small or no raise this year.
14. Are there any deadlines I should know about?
Rumor is that Obama will stop violating his own law and will impose the business mandate after the 2014 election.
Beware if your small business employer is barely making ends meet or if you are a low skill worker and your employer does not provide health insurance. The mandate will raise the cost of employing you. If you are not producing enough goods and services to justify the increase in labor costs, your employer will either cut your hours to part-time to avoid the mandate or fire you.
“Nether party wants to cut Social Security benefits.
Neither party will have a choice.
SS went into deficit during the Obama depression because so few young people can find full time work. Even if we manage to reverse the destructive policies of the past few years and young people can find work again, there are not enough of them to pay for the Boomers.
“Free markets feature the business cycle - growth followed by recession followed by more growth. Essentially, four steps forward and one back.
A depression - a recession followed low or no growth far below that of a normal business cycle recovery - is entirely a creature of progressive and socialist governance.
The 1929 market correction was over in 1929 and was nearly fully recovered by 1930. What turned this recession into a depression was Hoover's millionaire's tax, tariffs and increase in spending. What extended the depression in the private economy until 1946 was New Deal misdirection of the economy and even higher taxes. FDR never reversed Hoover policies, he doubled down on them.”
“As they say in sports, you are what your record says you are.
The United States has only suffered from economic depression (a recession without a recovery) twice in its history and both under progressive government.”
MoeB on Jun 5, 2014 at 12:18:50
“You seem unable to separate your partisan OPINION from reality.
The Great Depression and its causes involved both the free market and some bad monetary policy decisions by government. Let me state again...both the FREE MARKET and GOVERNMENT were the cause...or to use your terms, a failure of both conservative free market and progressive government.
To explain this simply: when the big banks started to FAIL in the late 20's, "free market" conservatives ideologies say let them fail...the problem there is that it causes panic and thus a run on the banks. If you want to stop this problem, it will involve some government intervention...thus, progressive government action.
Stop being so blinded by your partisan bent. there is no perfect economic or political system, meaning this idea of yours that conservative free market anything is THE way to go is misguided at best.”
“We have not had anything approaching a conservative free market government since Clinton/Gingrich.”
MoeB on Jun 4, 2014 at 09:53:09
“Again, you're glossing over reality in order to make a partisan point...conservative free market GOOD...progressive market BAD. I get it. People like to stick to their ideologies. An unfettered free market doesn't spread the wealth, it concentrates it.”
I defend cases like this and you cannot obtain a judgment in a CO court by simply mailing a letter to the last known address.”
LeftRight on Jun 3, 2014 at 11:49:51
“Except for the fact that such a thing is happening. It's likely happening in a tiny minority of cases, but it IS happening!!
I've just had to pay a debt collector for a debt from 5 years ago, WHEN I WAS LIVING IN MY CURRENT HOME, because the company that I owed the money to claims that they sent 5 separate notices to my home. Not a single one ever reached me. I probably could have fought it, but by that point in time it's not worth my time or my energy to do so.
Debt collectors KNOW this, so they will take advantage of it even when they are acting illegally!”
“It is difficult to make profits of the millions our progressive government has unemployed and impoverished.
Outside of government, finance and high tech, the rest of the economy is in a recession within a six year depression.”
MoeB on Jun 3, 2014 at 11:00:30
“LOL at "progressive government".
Progressives and conservatives in government got us here...let's not pretend otherwise in an effort to make a partisan point. We opened our government up to the largest bidder (well, either that or we gave them no-bid contracts), allowed special interest groups (on both sides) to take over our legislative process, and this is what we get in return.
You think Bank of America/Merrill Lynch gives a crap about whether our government is conservative or progressive? NO. They'll just hedge their bets.”
“The creditor needs to serve you with the complaint.”
LeftRight on Jun 3, 2014 at 08:45:12
“And they often DO NOT DO SO!!! That's the point we're making.
They send a letter to an address that you had many years ago, it doesn't get forwarded, you never even KNOW that they are taking you to court, and then suddenly there's a judgement against you which you've had NO chance to argue against!”
“You are confusing obtaining a judgment for the debt and penalties with actually collecting on the judgment through garnishments and liens. Inability to pay is not a defense against the judgment, but can limit how much the judgment creditor can collect.
Once again, when you purchase the debt from the original creditor, you step into the shoes of that creditor and may exercise all of their rights.”
“In a collection action, the plaintiff has to serve a summons stating exactly when and where to appear in court and often a form answer to make it easy for the debtor to respond to the complaint.
There is no real excuse short of an inability to read which would excuse a failure to appear in court.
The reality is that most of these defendants are blow off court like they blow off their debts.”
isc121 on Jun 2, 2014 at 22:32:24
“Except when, say, it is a 3 year old debt. And person X moved 2 years ago. The only address is the old one, no forwarding service anymore. And the agency decides not to bother. Service in many places is not, per se, you hand me a document and I sign. Lots of place let you mail it and it is assumed that if not returned, which just involves the new resident throwing it out instead of giving it back to the USPS.”
“Judges do not routinely ignore the law. If the rare one does, then the debtor has the option of appeal.”
isc121 on Jun 2, 2014 at 22:34:45
“They ignore proof of service all the time. As a former ADA I have seen it on the criminal level. Where people in my office swore they served someone, didn't, and the judge, to move on, issued an arrest warrant instead of asking for proof.”
LeftRight on Jun 2, 2014 at 12:59:20
“Which takes time and money that most people don't have, and in the meantime you've got to convince the judge to put a stay on the previous ruling while your appeal winds through the court system, which they are EXTREMELY unwilling to do!”
“Tomatoes and tom-ah-toes. Either this is a law firm doing collections or a collections business engaging attorneys. They are all third parties and the debtor has the same rights as if the original creditor was bringing the case.
Inability to pay is not a defense to a debt collection action. That is what bankruptcy is for.”
Anne Rutherford on Jun 3, 2014 at 12:57:13
“Bart, you are making some mighty assumptions here. First, if you read the article, you would realize that these 3rd party folks are placing leins on folks who do not actually owe the debt. This happens more frequently that you might want to admit. As for an attorney involved, not necessarily - pretty easy to file in court, paralegals do it, and workers can be trained to submit paperwork. Judgment is automatic is the the defendant fails to show (and many were not not notified). Something isn't right about this and you, as an attorney, know that. Not an attorney, but have worked in legal for years. Very different than a standard debt directly owned and judgment.”
tarheelblue25 on Jun 2, 2014 at 23:41:51
“Except third parties frequently ignore statue of limitations. What do you advise your clients when the statue of limitations has passed for the debt to be collected?”
zackrspv on Jun 2, 2014 at 14:13:16
“Bart, I didn't claim that inability to pay was a defense for a collection action. I did, however, state that inability to pay is a defense in court. The judge will do their best to ensure that the creditor is awarded the money that is owed, which means they will enter a default judgement; however, if the debtor doesn't have the assets or monthly income to even pay, the judgement will be for nothing, or for incredibly little, be delayed, or outright vacated.
You, as an attorney, should know this.
Secondly, as an attorney representing a business, you are a 2nd party debt collection agency; if you purchased the DEBT from the creditor in order to do the collection, then you are third part. And, in that case, you are far less likely to obtain payment for the obligation.
I operate a law firm. When I have a grossly delinquent debt, I engage a collections attorney. I hardly have the time to do these collections myself and most businesses do not have the expertise to do so.
The collections attorney simply collects what is owed under the original contract. They can't collect anything extra.”
zackrspv on Jun 2, 2014 at 12:12:16
“Bart, they are not talking about collections attorneys. They are talking about 3rd party debt collection agencies which buy the debt from the original creditor, and pursue legal charges and collections against the debtor. It is in those cases, however, that the consumer has quite a few options available to them, and the chances for collection are severely decreased.
In your case, you are representing the original creditor, thus, the consumer's choices are very much limited.
And, to note, not everyone who owes a debt can pay it back. There are extenuating circumstances to every situation (which is why we have a court of common pleas in this country, and why our legal system is adversarial based). Not everyone who owes a debt also willingly borrowed the money (medical debt, for example), and many who did borrow the money (Credit cards, auto loans, home loans, etc.) do often run into issues paying these off, which is why they go delinquent in the first place.
It is up to the debtor to work with the creditor to ensure the loan is paid off; but if the creditor refuses to help, and understand, if often goes to people like you, or a collections attorney to take the person to court . In that case, the debtor can defend themselves, justly, and usually win, by showing they do not have the assets to pay off the loan.
You may want to be a bit more forgiving in the future.”
“Generally, before a court can enter a default judgment when the defendant fails to appear, the creditor has to provide evidence of service of the complaint and then evidence of the debt.
None of this is new.”
LeftRight on Jun 2, 2014 at 11:43:58
“Not true. The fact of the matter is that while the laws STATE that, the judges IGNORE it.”
Brad Wiltshire on Jun 2, 2014 at 11:08:01
“Exactly! I am suspicious of all the people who claim they were never notified that they were sued. A judge will not grant a default judgment against a defendant without PROOF of service. Perhaps these people had no idea what they were being served with, but I am skeptical that they received no notice whatsoever.”
“When you borrow someone else's money and then fail to pay it back, did you really think they had no legal recourse to recover their money?”
Martha Fair on Jun 2, 2014 at 19:48:22
“If you even bothered to read the article you would find that many times these debt collecting firms can't find the real dead beats so they sue anybody they can find to blame the debt on...get it yet? I hope you are next LMAO - knowing YOU though, you probably are a phone collector for them. Always scamming for the wealthy and looking out for their best interests aren't you? You must be a maid or a butler and depend upon the benevolence of the wealthy. Another groupie for the willingly exploited.”
Cindy Campbell on Jun 2, 2014 at 16:10:24
“Of course they do, but as this article stated, it seems they don't even care if they have the right person or not. Unfortunately, nothing new, though...we had this happen to us about 15 years ago while the hubby was active duty. We were transferred to a different state, and we'd just barely gotten the boxes unpacked when delinquency letters started coming in the mail and then the phone calls started. I have a somewhat common name, and I guess someone saw my name somewhere and didn't bother to check. We ended up having the military deal with them, they absolutely would not accept that I wasn't who they wanted. And I feel truly sorry for the next person with that name they found. Legal recourse? Yes. Legal recourse to go after the wrong person and cause an untold amount of damage to that person's life? No.”

I signed up for a credit card machine for my company so I could process cards, Company A and I hammered out a deal for $25 a month no contract, company B showed up and pretended to be working with company A and started billing me $250 a month and claims we had a 2 year contract.
I tried to cancel, never used the machine and they are still trying to take me to court for $1500 they claim I owe.
Didn't borrow money, didn't agree to repay just wanted to swipe credit cards... Never used the service once, still being sued though.”
BBackSoon on Jun 2, 2014 at 10:11:15
