What can you do?

If you use employer provided group health insurance, your premiums and/or deductibles went up to pay for the new Obamacare mandates and your plan is being taxed to subsidize the exchanges. Your employer may or may not have disclosed this to you or paid for the increases. If your employer paid for the increases, you will get a small or no raise this year.

14. Are there any deadlines I should know about?

Rumor is that Obama will stop violating his own law and will impose the business mandate after the 2014 election.

Beware if your small business employer is barely making ends meet or if you are a low skill worker and your employer does not provide health insurance. The mandate will raise the cost of employing you. If you are not producing enough goods and services to justify the increase in labor costs, your employer will either cut your hours to part-time to avoid the mandate or fire you.

Not a single one ever reached me. I probably could have fought it, but by that point in time it's not worth my time or my energy to do so.

This happens more frequently that you might want to admit. As for an attorney involved, not necessarily - pretty easy to file in court, paralegals do it, and workers can be trained to submit paperwork. Judgment is automatic is the the defendant fails to show (and many were not not notified). Something isn't right about this and you, as an attorney, know that. Not an attorney, but have worked in legal for years. Very different than a standard debt directly owned and judgment.”

They are talking about 3rd party debt collection agencies which buy the debt from the original creditor, and pursue legal charges and collections against the debtor. It is in those cases, however, that the consumer has quite a few options available to them, and the chances for collection are severely decreased.

In your case, you are representing the original creditor, thus, the consumer's choices are very much limited.

And, to note, not everyone who owes a debt can pay it back. There are extenuating circumstances to every situation (which is why we have a court of common pleas in this country, and why our legal system is adversarial based). Not everyone who owes a debt also willingly borrowed the money (medical debt, for example), and many who did borrow the money (Credit cards, auto loans, home loans, etc.) do often run into issues paying these off, which is why they go delinquent in the first place.

It is up to the debtor to work with the creditor to ensure the loan is paid off; but if the creditor refuses to help, and understand, if often goes to people like you, or a collections attorney to take the person to court . In that case, the debtor can defend themselves, justly, and usually win, by showing they do not have the assets to pay off the loan.

You may want to be a bit more forgiving in the future.”

Unfortunately, nothing new, though...we had this happen to us about 15 years ago while the hubby was active duty. We were transferred to a different state, and we'd just barely gotten the boxes unpacked when delinquency letters started coming in the mail and then the phone calls started. I have a somewhat common name, and I guess someone saw my name somewhere and didn't bother to check. We ended up having the military deal with them, they absolutely would not accept that I wasn't who they wanted. And I feel truly sorry for the next person with that name they found. Legal recourse? Yes. Legal recourse to go after the wrong person and cause an untold amount of damage to that person's life? No.”

I signed up for a credit card machine for my company so I could process cards, Company A and I hammered out a deal for $25 a month no contract, company B showed up and pretended to be working with company A and started billing me $250 a month and claims we had a 2 year contract.

I tried to cancel, never used the machine and they are still trying to take me to court for $1500 they claim I owe.

Didn't borrow money, didn't agree to repay just wanted to swipe credit cards... Never used the service once, still being sued though.”
