9th circuit is trying hard to "distinguish" this case(prop 8) from other cases so that sup ct will NOT intervene......
if they write their opinion in such a way as to ONLY apply to Cali(9th circuit decisions are binding on ALL STATES in the 9th circuit(8 or 9 states))......they may escape sup ct review, if not, sup ct would have no choice but to review it since it could change laws in Alaska,AZ,hawaii,montana,idaho,nevada & oregon.......”

I don't think they will be able to get away with writing their opinion that narrowly. The same issues on the table under Prop 8 will apply to the vast majority of states with anti-gay marriage laws on the books. Ted Olsen was on an interview Friday (I think it was Hardball), and it sounds like they are leaning towards taking it to the SC. Even though the 9th seems to agree with the lower court, it will probably be appealed, eventually. It may be on youtube.”
