Why Google Is Not Microsoft

Stephen D. Houck served as lead trial counsel for the 20 state plaintiffs in the government's lawsuit against Microsoft while he was chief of the Antitrust Bureau for the New York State Attorney General's Office from 1995 to 1999. He is an advisor to Google.

Thirteen years ago, in August 1998, I sat across a boardroom table from Microsoft co-founder Bill Gates for a deposition as part of the antitrust case brought against the company by the U.S. Department of Justice and 20 states. When the courts found that Microsoft had violated the law, the case showed the crucial difference between legitimate business competition, which the antitrust laws are intended to encourage, and illegal, strong-armed monopolistic practices which thwart competition and deter innovation.

This week, Eric Schmidt, Chairman of Google will be questioned by the Senate Subcommittee on Antitrust, Competition Policy and Consumer Rights about practices currently being reviewed by the Federal Trade Commission. Google's competitors and some observers have sought to identify similarities between Google and Microsoft as a result, but the companies, and the facts about their respective behavior then and now, could not be more different.

Simply put, Google is not Microsoft.

Antitrust law is about behavior. It's not about whether a company is big and successful -- it's about whether it is big and bad. Microsoft was both. With 95 percent share in the market for PC operating systems, Microsoft had unprecedented power over PC manufacturers who needed Windows to sell PCs, and it used that power to squelch competition. At trial Microsoft was found to have wielded its Windows monopoly to punish PC manufacturers who wanted to use products made by Microsoft's competitors -- most prominently a small startup company, Netscape. This had the effect of protecting the Windows monopoly, punishing those who pushed back on Microsoft's licensing terms, and raising prices for consumers.

In addition, Microsoft threatened to withhold technical information from software developers who wanted to write programs for Windows that might have eroded its monopoly. Microsoft also made it impossible to fully use other company's products on Windows and difficult even to install some rival programs. The purpose of Microsoft's conduct? To protect the huge profits it made from the high prices it charged consumers for Windows. Not surprisingly, the courts found that Microsoft had used its monopoly power illegally to stifle innovation, limit consumer choice and harm competition.

Flash forward 15 years and it's hard to understand exactly what the antitrust concerns are when it comes to Google. Yes, Google is big, but its share of search queries hardly seems 'durable.' Once as high as 75 percent a few years ago, it has fallen steadily since, losing a point of market share last month to drop to 64 percent, Microsoft's Bing search engine has climbed every month since launching just over two-and-a-half years ago. By taking over search engine responsibilities for Yahoo! and powering the search features of Facebook, the most popular site on the Internet, Microsoft now has nearly one-third of the market to two-thirds for Google. In stark contrast, Microsoft's share of the PC operating system market has stayed above 90 percent for decades.

No company is perfect and Google has undoubtedly made it share of mistakes. But it's difficult to understand how Google could fairly be compared to Microsoft. Google's consumer services are provided free to consumers, not at monopoly prices. Consumers who want to use Yahoo! or Bing instead of Google for internet searches can do so quickly and easily. They pay no price and suffer no loss for doing so. Indeed, consumers use more specialized search engines than Google for specific purposes every day (WebMD for health, Opentable for restaurants, Amazon for books) and Google does not try to stop them, penalize them, or make it more costly to do so. While Microsoft's monopoly was protected from competition by users' dependence on Windows programs, Google actually makes it easy for users to switch. User data is portable, so if consumers want to switch from Gmail to Hotmail or change her document service to Microsoft's Live 365, they are not locked into Google's products. They can easily pull data from Google's servers and take it anywhere they want.

While Microsoft's actions perpetuated its Windows monopoly and kept prices high, Google's innovative free services have benefited consumers and stimulated competition across the Internet. That makes all the difference under the antitrust laws. It is critical that today's antitrust enforcers recognize that difference.

With 95% installed base, it could be argued that it was a matter of national security to have the freedom loving democracy "negotiate" its hooks into MS's business. Granted, MS made for any easy excuse. At&t and IBM had similar fates, and are now cozy cooperators who enjoy the benifits of retroactive immunity.

"Don't be evil" mindset is not the usual mantra of businesses. It's going to be difficult to rope in this loose cannon. In the meantime, we the consumers will continue to benifit from this unbridled, innovative, and productive quintessential Amercan company.

Microsoft still has 95% of the PC-market because/and it has 95% of the Office market... nothing has changed... i don't understand what they reproach to Google... eBay or Facebook are also monopoly : they don't abuse of it, unlike Microsoft did : with Explorer on Windows in 1995, at this time, it was very difficult to install another browser : no DSL, but only old phone-modems...
The "consumer can choose" from Microsoft was not true.
Consumers can choose, if they can in one click change from service (like now between Google, Yahoo or Bing).
Anyway, today, to change the browser is not easy as a "click", but it is easier than in 95 : that's why, the market share of explorer is no more 95%... but that's why it is still 50%. For me, more, than it should have... the 50% are mainly because, it is installed by default. like the 5% of safari. the market share of firefox and chrome, is the market share of people who really decided to change from browsers.

So in other words... putting a free web browser or media player in your OS is bad (if you're Microsoft)... but pushing your companies products to the top of a search is bad... but only if you're Microsoft? Is that pretty much how this discussion is going?

Stephen, I am sorry, but you are missing a lot here. By virtue of small businesses reliance on Google Search and Google Advertising, they have placed themselves between numerous companies and buyers. Their Search dominance is one thing, it is all the other businesses they purposely try to squash. What if they crush Facebook with Google Plus? What if they push away all the cell phone companies that are not Motorola? What if the crush Groupon and Living Social with the new Google Offers.

These are just a few of many areas where Google is positioning themselves for dominance. They are not trying to dominate one market, they are trying to dominate tons of markets. The only reason why Facebook is showing Bing results and Partnering with Yahoo and Microsoft is to counter Google's attack on them.

Everyone can see it. What else is it going to take? Should the Government wait until Google has everything and everyone else is already out of business?

Freedom to choose implies free access to all options. Something Google is not particularly good at providing.

Furthermore, if Google's case is so strong, does it not follow that they have no need of hiring lobbying firms - not just lobbyists like Houck, but entire firms - to influence Congressional opinions and grease Congressional skids?

Not to mention seeking advice and hiring consultants from the Heritage Foundation, and the American Enterprise Institute, to launch a campaign against an investigation headed by a Democratic Senator?

Seems to me that Google's habit of promoting closed-ecosystems and hidden-preferential treatment is finally catching up with them.

Before reading you article my comment would have been
"Why because MS does not own them or stolen them"

I agree, they were always a monopoly ever since IBM gave them DOS and sold DOS for free and charged $800 for CMS.

40 year in IT and IBM when I did mainframe work, I want to have IBM because they were GREAT and above all competition until AMDAL. MS would steal your knowledge and Apples Visual OS, IBM's Multi-Tasking OS then break the contract and get it for free

Bill Gates was no programmer he was a businessman and Marketeer.

I use Mobile Computing with RF, GPS and Beta Scanners. It was a breeze and took 2 weeks to create Command and Control with 4-wheelers, tractors, Semi's and Choo Choo Trains. With no data entry. TODAY because it took only 2 weeks I don't have 10 years and am still trying to do it. I am afraid of how the New Simple is I don't want to try. Until of course they cannot do it and it is a show stopper and then they will seek me out.

Also, if you think that Microsoft stole something from Apple, you should look into where Apple stole the idea from first.

LOL, never heard of windows or worked for MS, Aye. The source of you content comes from what? Imagination? I can only speakf or what it said I was not commenting at all on Apple or comparing to Apple

I only know what I know and the comment is not Mutually Exclusive of what I or you know

Google is not a search company, it is an advertising company. This is the grounds on which the antitrust case needs to be looked. Does google use it's search and other side businesses to unfairly protect its ad business to the detriment of others?
