Why I Want a Medical Marijuana Dispensary Near My Children's School

Last week, one of California's oldest and most respected medical marijuana dispensaries, Berkeley Patients Group, closed its doors. It shut down because its landlord, like dozens across the state, received a letter from United States Attorney Melinda Haag threatening to seize the property for renting to a medical marijuana dispensary located within 1,000 feet of a school. My three children attend elementary school and preschool in West Berkeley, just blocks from Berkeley Patients Group. The notion that the closure of Berkeley Patients Group is going to somehow serve to protect my children is patently absurd.

Berkeley Patients Group served thousands of medical marijuana patients in the Berkeley area for 12 years. It was an industry leader and a model of compassion and legal integrity. It was in strict compliance with state and local law, and has long worked with the City of Berkeley and the local community to provide a safe and responsible service to patients in need. As a small business, it employed 75 people and was one of the top sales tax generators in the city.

Ms. Haag has claimed that one of her concerns about dispensaries that are in close proximity to schools and parks and playgrounds is the possibility they could be the target of violence or armed robbery. Banks and pharmacies are also targets of armed robberies and there are a number of them located in West Berkeley. Like Berkeley Patients Group, they have security. There is no evidence to suggest, and I have never felt, that it is dangerous to send my children to a school that happened to be near a bank, or a pharmacy.

West Berkeley is not crime-free. There have been a number of shootings in the blocks surrounding my children's elementary school in past several years. There is also significant illicit drug traffic in the neighborhood. The two are likely connected. But thus far, Ms. Haag and the federal government have devoted few, if any, resources to protecting children from gun violence or other crime in West Berkeley.

Instead, Ms. Haag has chosen to use her presumably limited resources to deprive the thousands of patients who frequent Berkeley Patients Group a legal, regulated, secure place to purchase desperately needed medicine. Of course, the closure of Berkeley Patients Group does not mean that these thousands of people will stop buying and using medical marijuana. They are sick, in pain, and are allowed to purchase and consume marijuana under settled California law (a law that was approved by voters overwhelmingly). Ms. Haag says that she is not going after medical marijuana patients. But she must understand that patients will now simply have to find marijuana elsewhere, from the streets, and near schools and parks. Ms. Haag has not made these areas safer; she has simply increased the demand for an illegal and dangerous drug market.

Ms. Haag also claims that her crackdown on dispensaries is necessary because of problematic marijuana use by high school students. The reality is that between 1996 (when California passed its medical marijuana law) and 2008 there was an overall decrease in teens' marijuana use. An analysis commissioned by the California Department of Alcohol and Drug Programs found "no evidence" to support the claim that legalization of medical marijuana in California increased marijuana use during this period. Providing thousands of new customers to illegal drug sellers on the street might increase access to marijuana by teenagers. The existence of Berkeley Patients Group, and other well-regulated small businesses across the state, does not.

Most offensive is the notion that legal access to medical marijuana sends the wrong message to kids. I find the existence of legal medical marijuana very easy to explain to my children. This is what I tell them: Research and science matter. The opinions of medical professionals matter. We should have compassion for those who are very sick, and even for those who are just a little sick; for those suffering the effects of chemotherapy or for returning veterans suffering from PTSD; that we should help meet people's needs and ease pain as best we can (even if it goes against the conventional wisdom or drug war ideology). I tell my children that it is better for people to buy marijuana from a safe, well-regulated source, than on the street.

I tell my children that the lives of children in Mexico matter too, where United States drug policy has led to the narcotics-related murders of nearly 50,000 people over the last five years, including thousands of children. That is the harm to children caused by marijuana prohibition, and a drug market that Ms. Haag's actions directly fuel. The "threat" posed by Berkeley Patients Group, and other dispensaries like it, pales in comparison.

Everyone in Berkeley smokes pot anyway, so it shouldn't matter about the location of a dispensary. However, in inner-city areas, medical marijuana dispensaries are just fancy drug dealers and less savory characters are present. In those areas the dispensaries should be far from schools.

Nice article Tam... I tried commenting prior but ?? I also wanted to address "TomHn" Which is it? Because I just read in another Huff®Piece where you wrote "you can tell who smokes pot because you can smell it on them" But in this blog you type "we had no idea" so which is it? see TomHn I am a "trained observer" and was medically retired from my police job in a city pretty close to the author's own, Berkeley. There is no test in the world that could possibly tell you that 'your daughter' was 'intoxicated' at an autopsy, only that cannabis was present in her system. Also the cannabis would have to be tested as there has been a big spike in chemically laden, dangerous crap labeled "K2" and "Spice" LegalBuds**NOT FOR HUMAN CONSUMPTION** and is sold as incense. (the crap Demi Moore shit her pants on)
So which is it? Do you want to admit you are lying? or do you want to lie about that too? For a 'parent' to come on the interweb and make up a dead daughter to further your cause is pathetic.

Not one instance of someone coming out of a dispensary, stumbling into their car and driving away to smash into someone else. Could you say the same for the 1000 bars and liquior stores allowed to operate freely. This is beyond being a farce, it is in the realm of the absurd now.

Oh yeah, protect the children. What a farce thrust on Americans.
Someday, someone, some group will do a real study on what the sum total cost would be aggregate, to the threatened "industries", and compare voting records along with campaign donations made by those Industies threatened by MJ,MMJ, and Hemp realignments for cash and revenue flows.

Maybe then, the true hipocracy of "Protect the children" would become transparent. Till then.... we will hear more of the same verbage from the enforcement of standard quo... has worked for years,,, will continue to be the best propoganda technique available... protect the children.

Protect the Liquer industry, protect the Pharma industry, protect Inforcement applicable job force numbers.
Keep away the threat of reducing the DEA agent count 50%, because there would be an accompaning 50% reduction in profits for Mexican drug cartels. Keep the Fed program where Helicpters can be distributed to local communities whom agree to use them a signifigant portion of time for drug grow finds. Protect the basis for Monsanto/seed genetics in soy and corn viable(As Hemp seeds are just as good). Protect the established wood farms and pulp mills as hemp fiber is better. Protect the Cotton industry as hemp fiber lasts longer. Protect the need for Drug Cartel money to washed thru Wall Street Central Bank Primary dealers to the Federal Researve(Have you seen some of the fines?Done the standard..Fine= 5-10% GROSS profits?).
Protect the influence on regional and world theaters as some countries have socio and military and fiscal concerns that affect their stability or security internally...and ONLY AMERICAN DOLLARS/ Dea and military can help the ruling class(Mexico, Afganistan to name a couple) ....all dependant on the influence of Narco Trade..... we do not want to lose that ability to influence world events... we must protect the Narco trade.. to enable "help" for those complicit-cooperative countries(ruling classes).

The new dea director came from the california region under bush and is very anti medical marijuana also and has written scathing statments on medi mari. Obama basically appointed a bunch of haters for the whole region..

In Holland it's the same, all coffeeshops in 500meter of a school had to close down. In my neighborhood there are 5 coffeeshops at 5min. walk while in other parts of Rotterdam there are none. Thanks to local government with different views. Like California is the only state who accepts use of marijuana on medical grounds. Not all marijuana users in California are really sick. but it's a way to legalize marijuana. Even the FBI/DEA can arrest me in California. The world could better focus on other problems then use of marijuana for pleasure,relief by sickness,clothes,oil,rope and many more can be done with the hempplant

You failed to mention how dispensaries tend to improve the neighborhoods with their presence. Around the same time that the land lord of the Vapor Room Cannabis Collective in the Lower Haight neighborhood of San Francisco receives "The letter" from US Attorney Melinda Haag, They also get a "Proclamation" From the Board of Supervisors of The City, and County of San Francisco in gratitude for all that they have done for the community. It cannot be denied, the improvements, or the change of the quality of life in that neighborhood since the Vapor Room first opened their doors. The only negatives in the now gentrified area might be that some of the members who are stroke victims walk funny, and those folks in the wheelchairs require more sidewalk space than the average pedestrian to get down the street. But lets show some compassion here.

I had a 17 year old daughter who was involved in a fatal automobile accident. In the SUV she was driving, the police found a bag of marijuana and later autopsy confirmed marijuana intoxication. We never knew she smoked pot and we felt great loss and anger. A simple weed took our daughter out of our lives.
For all the parents out there, the only way to protect our kids is to take marijuana our of their hands. We support our DEA's effort on war on drugs.

Sorry for your loss, if marijuana was sold like alcohol with id and not before 18,it would be the same as drunk driving,stupid but still happens. So blame driving unther influence cause an overdose is physical not possible with marijuana.
