A nurse technician at Kendall Regional Hospital is accused of sexually assaulting a Baker Acted patient.

Luis Alfonso Lucero, 37, of Hialeah was arrested Sunday by the Miami-Dade Police Department for the alleged rape of a 45-year-old patient on Aug. 2, according to police.

The woman, who was at the hospital under a Baker Act and for alcohol intoxication, was reportedly under Lucero’s care in a hospital room when the assault took place.

“A control telephone call was conducted with the victim and the subject, where [Lucero] admitted to the victim that he had sexual intercourse with her while she was hospitalized,” the arresting officer wrote.

After he was read his Miranda rights, Lucero told police that the sexual intercourse was consensual, according to the report. He was charged with sexual battery.

Carlos Alfara, the manager of the apartment that Lucero lives in, told Telemundo 51 that he was surprised by the arrest and that his tenant pays the rent on time and lives with his son, NBC 6 reports.

Police are investigating whether or not there are other victims.
