In his first appearance as a member of the House Judiciary Committee, Colorado Congressman Jared Polis grilled Attorney General Eric Holder on recent Drug Enforcement Administration (DEA) raids of medical marijuana facilities In Colorado.

Polis's questioning came in the wake of a controversial decision by the DEA in Colorado to raid the home of a Denver-area medical marijuana grower. The raid came after the release of a Justice Department memo advising the DEA not to focus its efforts on medical marijuana growers who were in unambiguous compliance with state law.

Jeff Sweetin, head of the DEA in the Denver area, has argued that the raid was justified because the agency had reason to believe that the grower was not in compliance with state law.

Polis asked the Attorney General to "describe the objective processes" by which the DEA determines whether individuals are in clear, unambiguous compliance with state law.

The AG responded that the issue is handled on a case-by-case basis, and that agents will look at factors such as whether firearms are involved in the transaction.
